Clarifications to queries posed by the vendors ref. ITB UKR/2010/007

1). Who will be the end user of the equipment?

Procurement is being conducted by UNDP on behalf of FAO, i.e. UNDP is the purchaser and FAO is the end user. For the purposes of tender submission bidders may address all documents to the attention of UNDP.

2). Could you provide tender information in Russian?

Unfortunately, subject tender is only available in English.

3). For equipment supplied from within the Ukraine, the local companies will apply VAT. Shall we clearly state in out price offer the value of the VAT and will the paid by us VAT be recovered by the UNDP Ukraine? We hope that we will be able to recover the VAT because is not, then that will contribute to our offer being more expensive then if we import the equipment into Ukraine from abroad.

Normally the price of the local bidders shall be inclusive of VAT (though clearly distinguished in the price proposal), while the price of international bidders shall be exclusive of VAT (however the shipping cost shall be clearly stipulated).

4). In the Bid Data Sheet there is requirement that the Prices quoted shall be 'DDP Kiev, delivery to S.khokhlovykh Str. 15'. However, usually the UNDP delivery terms are DDU with delivery to the end address. Please clarify if the contractor will have to pay all the import taxes and duties for the imported equipment as per your quoted delivery term DDP?

FAO requested that applicable Incoterms be DDP, and not DDU. All bids shall be submitted accordingly.

5). In reference to Para 9, Instructions to Bidders

Document to be presented:

'copy of all applicable licenses and permissions for supplying respective goods, Issued by Ukrainian authorities'.

Does this mean, only Ukrainian companies are authorized to Bid?

Any company (whether local or international) is eligible to participate in this tender. It is however understood that the imported equipment shall be in conformity with Ukrainian regulations and applicable certificates of quality/conformity shall be furnished by the bidder as part of tender proposal.
